Our client’s father was in his 80’s, and had recently been diagnosed with terminal leukemia. The family had made arrangements to have a home health agency provide attendant care for their father 24/7 for his safety and for respite. One evening their father was being helped to his room by the home health aide with a walker, when he fell forward striking his head on a door frame. The aide put our client’s father into bed and alerted nobody about the head trauma. The following morning it was discovered that he was unconscious and not responsive. The aide did not tell anyone about the fall until the family was told that there were serious head injuries, and he was confronted. He subsequently died of a brain bleed.
