Our client’s mother was 77 years old and healthy when she suffered major head trauma when she was blown down by a large flying pool umbrella while on the pool deck of an Aventura condo that is located on the Intracoastal Waterway. Evidence revealed that the condo staff and management knew that the pool deck was frequently subject to windy conditions, and that the large pool umbrellas would blow over despite being placed into heavy concrete bases.
Insufficient steps were taken to secure the large pool umbrellas to address the wind dangers, all of which caused the safety risk that killed our client’s mother in what would have otherwise been simply chalked off as a freak accident.
